Large scale metals mining under the disguise of a zoning bill aimed at countering the Second Popular Initiative is not going to pass the Legislature as easy as planned. Massive street marches and declarations of rejection, together with claims of lack of transparency and taking advantage of the restrictions imposed by the covid pandemic, are reasserting a claim born 18 years ago with the No a la Mina movement in Esquel.

While the mining zoning bill failed to pass a commission vote last week, more than three thousand people took to the streets in Esquel for the 18 years of the No a la Mina, reported Radio 3 on December 4, in what was described as "an historic and emotional day."
A Document released by the Esquel Assembly called on "provincial legislators to approve the Bill No. 129/20 Second Popular Initiative presented by the Union of Assemblies with the support of more than 30,000 signatures.

At the same time, marches took the streets in Trelew and other towns and localities in the Cordillera, mesetas and coast of Chubut.

A set up staged for counterfeiting
The proposed Bill No. 129/20 Second Popular Initiative achieved parliamentary status on November 23rd with the support of more than 30,000 signatures and massive displays of love. The legislative initiative also has the support of the Deliberative Councils of Madryn, Pirámides, Rawson, Esquel, Trevelin, Lago Puelo, Epuyén, El Hoyo, Río Pico and José de San Martín.
For its part, a mining law project presented by the Executive in two Zoom sessions obstructed the debate around the Second Initiative, which they don’t want to discuss in itself, but together with the zoning designed by the Geological and Mining Survey of Argentina (Segemar).
The mining bill aimed at blocking the exercise of direct democracy in Chubut is similar to the zoning approved by decree ten years ago in neighboring province of Santa Cruz, which has been governed by the current highest legislative authorities of Argentina for the last three decades, and where Pan American Silver and Yamana Gold operate a piacere.
The government of Mauricio Macri appointed Carlos Cuburu as executive secretary of Segemar in early 2016, who held the position until May 2019. Cuburu was manager of Minera Argenta (Aquiline Resources), the previous operator of the Navidad silver-lead-zinc project until its sale to Pan American Silver in 2009.
However, the main political parties in Chubut have stated that they will not vote the zoning bill in the legislature.
A document signed by UCR provincial directive commission highlighted that "mega-mining is not the way out of the crisis, we do not believe that this provincial government is capable of guaranteeing environmental controls in accordance with the practices of mining companies, we do not believe that the output from this activity is more important than caring for water and the environment."
Diario Jornada in Trelew reproduced a statement signed the president of the Chubut Justicialist Party, Carlos Linares, who warned that "laws cannot be passed without social consensus and in the context of economic and power asymmetries between mining companies and civil society". The leader also demanded that the issue "deserves another type of debate and therefore we ask the provincial Executive Power to withdraw the zoning bill from the Legislature to begin a serious, responsible, scientific discussion." For the leadership of the PJ, the legislative process "cannot be limited to three hours by Zoom with the participation of 27 legislators who analyze a unilateral position. We do not deny any possibility of development, but we consider that the lack of credibility of the provincial government and the effects of the pandemic, require other timing and different methodology".
In a document addressed to the Legislature of Chubut, the aboriginal communities of the north-central plateau of the province asked the Chamber to refrain from advancing with the treatment of mining zoning, since it was drafted "in violation of the rights of Indigenous Peoples ”and against ILO Convention 169. In addition, they required the legislature to desist from dealing with any project to enable mega-mining without making effective consultation and participation of the communities, in a free, prior and informed manner. The document bears, among others, the signature of Hortencia Huicha, lonko of the Los Pinos Community; Samuel Cual, lonko from the Mallín de los Cual Community; and Eusebio Morales, president of the Laguna Fría and Chacay Oeste Aboriginal Community.
The Argentine Catholic Information Agency (AICA) stressed that the bishops of Chubut once again rejected the bill "Sustainable Metal Mining Industrial Development" and asked Governor Arcioni to desist from the plan. Through a joint document, the Chubut prelates lamented the lack of responses to the various requests from participatory bodies and stated that "in this situation, we say NO."
Researchers from the National Technological University (UTN) and Chubut Regional College, questioned the project presented by the provincial government to enable mega-mining in the central plateau. “A zoning for a single activity is a mistake”, they stated, specifying that “the pertinent thing is to approach the evaluation and territorial planning in a comprehensive manner, taking into account the multiple socio-environmental facets of the territory. Sectoral zoning only for mining will fragment the territory and harm other activities due to incompatibilities and competition in land use, "they argued, in addition to" exposing the water quality of the Chubut River to degradative processes, which supplies numerous productive activities and 50% of the population ”.
Nobel Prize winner Pérez Esquivel sent a letter to the provincial government demanding that: "Chubut has only one river!" The letter addressed to the provincial legislators by the Justice and Peace Service (SERPAJ) denounced the repressive and mega-mining scheme in Chubut with "methods that remind those applied by dictatorships which advance on the environment without consulting the communities."
"The desperation to approve the zoning between roosters and midnight was evidenced," said Pablo Palicio Lada, a spokesperson from the Chubut Assemblies in Trelew, referring to Governor Arcioni's conference to defend the project that would enable large-scale mining in the provincial territory. «He repeated again that the Chubut River will not be touched, but if one takes a closer look at the zoning map, the river is touched. No article of the bill does actually say that the river will not be touched” the assembly member demanded. "It must be said that it is no coincidence that this project was presented together with the Second Popular Initiative, they sought to cancel its discussion due to the social support it has garnered."

Esquel, 4 de diciembre de 2020, Documento de la Marcha Aniversario: 18 años del NO A LA MINA EN LAS CALLES
VECINAS Y VECINOS:
Hoy no es un 4 más: cumplimos 18 años de marchas desde aquel primer 4 de diciembre del 2002, cuando el pueblo de Esquel decidió que marcharía hasta que las mineras se fueran. Y aquí estamos.
Resistimos con dignidad, uno tras otro, los embates de las empresas mineras y de los Gobiernos de turno. Las montañas siguen en pie, la Meseta sigue sin tajos y el río corre cristalino por su cauce GRACIAS A SU GENTE.
Pasamos estos últimos años, en estado de alerta permanente y movilizados, enfrentando sucesivas embestidas e intentos de engañarnos. Hemos demostrado que el pueblo informado y consciente rechaza los proyectos de explotación minera y sus espejitos de colores.
Hoy el Gobierno de Chubut va en contra de lo que el pueblo quiere: vemos que los funcionarios solo representan sus intereses personales y se muestran en los medios como voceros de las corporaciones mineras, que hace años empezaron su proceso de contaminación en nuestra provincia, pudriendo las instituciones que la conforman y corrompiendo a los mercenarios que se dejan corromper.
El Gobierno de Mariano Arcioni ha llevado a la provincia a un estado de zozobra y desesperación, agravado este año por la crisis sanitaria, con la única intención de justificar la instalación de un proyecto minero que comenzaría en la meseta. Dice el gobernador que quiere un debate serio, pero presenta un proyecto de zonificación vergonzoso, redactado a espaldas del pueblo. Lo presenta 17 años tarde, ya que la Ley XVII-Nº 68 (Antes Ley 5001) en su Art. 2 estipula un plazo de 120 días para avanzar con la zonificación, plazo ampliamente vencido gracias a la firme resistencia popular. Además, lo presenta de manera ilegal, ya que no se ha realizado la consulta previa a las comunidades mapuche-tehuelche, como manda el Convenio N° 169 de la OIT. Lo presenta falseando informes del Consejo Nacional de Investigaciones Científicas y Técnicas de Argentina (CONICET). Lo presenta sin consultarles a las instituciones científicas más importantes de nuestra provincia, tal como lo denunciaron la Universidad Tecnológica Nacional (UTN), el Instituto Nacional de Tecnología Agropecuaria (INTA), la Universidad Nacional de la Patagonia San Juan Bosco y el CONICET. ¡Lo presenta yendo en contra de la voluntad del pueblo, que desde hace 18 años le dice NO a la instalación de proyectos extractivistas, saqueadores y contaminantes!
El Gobierno provincial, de la mano del Gobierno nacional, está violentando al pueblo de Chubut y prendiendo la mecha del conflicto social. Insulta a un pueblo que tiene sobrados fundamentos científicos y políticos para decir que NO quiere proyectos de megaminería en su territorio. Decimos NO porque sabemos que solo traerán contaminación, corrupción, devastación y que serán la sentencia de muerte de cualquier proyecto económico verdaderamente sustentable, como las energías renovables, la agricultura, la pesca o el turismo, entre tantos otros.
El gobernador Arcioni construyó su gobierno con especulaciones y con traiciones: es un MENTIROSO que le ha faltado el respeto a sus votantes y a todo el pueblo de Chubut. Con cada gesto demuestra su desconocimiento y desprecio por el pueblo al que debe representar, en especial por la dignidad de los/as pobladores de la meseta, quienes resisten en el territorio la presión de jefes comunales que llegaron a esas tierras con la codicia como guía.
El gobernador habla de no tocar la Cordillera, pero sabe que a principios de año se reactivaron los negocios sobre el Cordón Esquel. También sabe que en el artículo 7 del proyecto de zonificación se deja la puerta abierta para que las mineras se sigan expandiendo. Y aunque no llegaran a la Cordillera: ¡NO admitimos zonas de sacrificio! ¡Nuestra lucha es también por nuestros hermanos y hermanas de las comunidades de la Meseta!
Mariano Arcioni, Ricardo Sastre y Alberto Fernández saben bien que los ríos, napas y ecosistemas interactúan entre sí. Saben bien lo que implicaría la explotación del Proyecto Navidad: por medio de las aguas y los vientos la contaminación afectaría a toda la provincia, especialmente a la zona costera. Pero NO LES IMPORTAN ni las aguas contaminadas ni el plomo que afectaría, sobre todo, la salud de niñas y niños.
Que no intenten distraernos con porcentajes del territorio: aunque se instalaran en un jardín o en un patio, solo sería el inicio. No por nada ofrecen todos nuestros yacimientos en congresos mineros internacionales.
Exigimos al gobernador Mariano Arcioni y al vicegobernador Ricardo Sastre que retiren el proyecto de zonificación presentado en la Legislatura provincial porque está repleto de información falsa, es ilegal y es ilegítimo: el pueblo NO LO QUIERE, NI LO PIDIÓ, NI LO VOTÓ.
Exigimos a los/as diputadas provinciales que den tratamiento al proyecto de Iniciativa Popular presentado por la Unión de Asambleas de Comunidades Chubutenses, sin modificarlo en favor de las mineras y sin las trampas que suelen realizar, como hicieron con la primera iniciativa popular en el 2014.
En estos 18 años el pueblo chubutense tuvo que enfrentar a todos los Gobiernos, hemos sufrido amenazas, persecuciones, difamaciones, criminalización, espionaje ilegal y represiones, pero pese a todo, seguimos de pie: ¡NUESTRA VIDA SE HA TRANSFORMADO EN RESISTENCIA!
Vecinas y vecinos: Estas semanas SON DECISIVAS: NO VAMOS A PERMITIR QUE HABILITEN LA MEGAMINERÍA EN CHUBUT. Y como sabemos que este modelo que intentan imponer solo cierra con represión, responsabilizamos al presidente Alberto Fernández, al gobernador Mariano Arcioni y al ministro Federico Massoni por la integridad física de cada miembro de nuestras asambleas.
¡Nos encontrarán en la calle, defendiendo el agua, la vida, la verdadera democracia y la dignidad! ¡Acá no se rinde nadie! ¡RESPETEN LA VOLUNTAD POPULAR: ¡NO ES NO!
¡El CHUBUTAGUAZO será IMPARABLE!
