Campaigners have urged the UN's Green Climate Fund to reject the involvement of HSBC and Credit Agricole, ahead of COP21.

A group of 88 NGOs, charities and academic bodies has penned an open letter to the board of the GCF, claiming that the accreditation of the two banks, which is currently being considered, would "pose serious reputational and moral risk to the GCF".

Accreditation allows an institution to receive and distribute money on behalf of the GCF. In July, Deutsche Bank came under similar fire from NGOs after it was accredited by the fund.

"The banks' accreditation would undermine the GCF's commitment to robust fiduciary standards and strong environmental and social safeguards... and would be contrary to what the GCF Secretariat has described as having 'GCF standards [that] build on best practices of global institutions'", said the letter, which was signed by Friends of the Earth, ActionAid US and BankTrack Netherlands, among others.

According to the group, the two banks rank among the top 20 private banks to finance coal. Credit Agricole invested more than €7 billion in the coal sector between 2005 and 2014, while for HSBC this figure was more than €7.9 billion.

"Both banks also back non-fossil-fuel-based sectors with a large negative impact on climate. HSBC is a major financier of Indonesia's palm oil sector, a sector characterised by driving deforestation on a vast scale, industrial agricultural excess, degradation of carbon-rich peatlands, human rights abuse, and labor exploitation," it said.

"Accredited entities should have exemplary policies and practices in place to adequately deal with potential social, gender equality, environmental, and human rights risks of the projects they finance. This is not the case with HSBC and Crédit Agricole," it continued, adding that HSBC has been accused of "bankrolling" logging companies in Malaysia.

The letter did not propose an alternative bank that would be deemed more suitable to receive and distribute the funds of the GCF. A spokesperson for Friends of the Earth, which led the campaign, told Environmental Finance that no "international banks should have direct access to GCF funds".

HSBC and Credit Agricole did not respond to requests for comment ahead of publication.

Livingstone, Zambia - The Green Climate Fund (GCF) must not channel its money through two scandal-ridden international commercial banks that are leading funders of the coal industry, say civil society groups at a meeting of the GCF’s Board in Livingstone, Zambia.

The groups say that the GCF must reject applications for accreditation by big banks HSBC and Crédit Agricole. Accredited entities are approved to receive and disburse a share of the $10.2 billion pledged to the GCF.

"The Green Climate Fund Board must reject applications from HSBC and Crédit Agricole. Creating new business for big banks with poor human rights records and large fossil fuel portfolios undermines the very purpose of the Fund,” said Karen Orenstein of Friends of the Earth U.S.

“Accepting HSBC and Crédit Agricole as partners at the Green Climate Fund will only confirm the suspicions of many governments and civil society organizations about the role of the private sector in financing the new Paris deal. Public funds must be used to support local communities in developing countries not to subsidize big banks,” said Tim Gore of Oxfam.

"When communities need support to cope with climate impacts, it is not loans or foreign investments that will help. There is no profit to be made in building the resilience of the poorest and most vulnerable. HSBC and Crédit Agricole are the wrong choices for a fund that is meant to directly benefit vulnerable communities,” said Sam Ogallah of the Pan African Climate Justice Alliance.

The GCF’s mandate to work directly with developing country institutions is what makes it innovative, the groups say. Targeted funding will help to build skills and expertise in poor countries, allowing governments to better meet the needs of the poorest and most vulnerable people in their countries.

"HSBC and Crédit Agricole are both heavy investors in the fossil fuel industry, which makes them the wrong partners for the Green Climate Fund. Commitments to deliver green projects are not enough. Private sector partners of the GCF need to have a credible strategy to make their entire portfolio and all of their operations consistent with human rights and with the 2° Celsius global warming limit set by the international community, and preferably a 1.5° Celsius limit,” said Lutz Weischer of Germanwatch.

Civil society groups are calling on the Green Climate Fund Board to only approve accredited entities with clear commitments to fighting climate change, and to prioritize the approval of domestic entities in developing countries.

The Board of the Green Climate Fund must reject the applications for accreditation1 of both HSBC and Crédit Agricole. Their accreditation would pose serious reputational and moral risk to the GCF via the banks':

The accreditation of HSBC and Crédit Agricole would run counter to the GCF's intent to be a game-changing institution with country ownership at its core. In turn, the GCF Board's rejection of their applications would be a strong mark in favor of maintaining the integrity of the Fund.

Major Financiers of Climate Pollution & Consequent Human Harm

HSBC and Crédit Agricole rank among the top 20 private sector banks financing coal.2 Between 2005 and April 2014, HSBC extended over €7.9 billion to coal, despite its own public advice warning of the risks of investing in this dirtiest of fossil fuels.3 In this same period, Crédit Agricole channeled more than €7 billion to the coal sector.4

The negative impacts of such coal investments extend beyond climate. By May 2013, HSBC had, for example, invested $3.133 billion in the companies behind the Cerrejon project in Colombia, South America's largest open- pit coal mine. In addition to its climate impact, Cerrejon is widely regarded as a human rights disaster, with widespread allegations of forcible displacement of farming communities and destruction of sacred sites, among others.5 Crédit Agricole is the lead arranger on a $6.8 billion corporate loan to Glencore, which co-owns the Cerrejon project. Crédit Agricole is also involved in the financing of the massive Medupi and Kusile coal power plants in South Africa, with immense environmental, social, gender, and climate impacts.6

Both banks also back non-fossil-fuel-based sectors with a large negative impact on climate. HSBC is a major financier of Indonesia's palm oil sector, a sector characterized by driving deforestation on a vast scale, industrial agricultural excess, degradation of carbon-rich peatlands, human rights abuse, and labor exploitation.7

Poor Protection of Human & Environmental Rights

Accredited entities should have exemplary policies and practices in place to adequately deal with potential social, gender equality, environmental, and human rights risks of the projects they finance. This is not the case with HSBC and Crédit Agricole. For example, both fall far short in their implementation of the UN Guiding Principles on Business and Human Rights. In a recent BankTrack assessment of implementation of the Guiding Principles, Crédit Agricole scored 2.5 points and HSBC only one point, out of a maximum of 12 points, leaving them at the bottom end of a list of 32 banks.8

This has played out to devastating effect on the ground. In Malaysia, a Global Witness exposé revealed, "HSBC has bankrolled logging companies causing widespread environmental destruction and human rights abuses in Sarawak, Malaysia, violating its sustainability policies and earning around US$130 million in the process....The bank is also providing financial services to companies widely suspected of systematic bribery and corruption."9

Money Laundering & Financial Mismanagement

HSBC has been at the heart of one financial scandal after another, with serious global ramifications. In 2012, a U.S. Senate investigation found that HSBC allowed Latin American drug cartels to launder hundreds of millions of dollars. That same year, HSBC paid more than $1.9 billion to settle U.S. criminal and civil investigations and agreed to a five-year deferred-prosecution deal.10 Crédit Agricole very recently agreed to pay U.S. authorities a $787 million fine for violating sanctions. The bank allowed - and covered up - transactions from Sudan, Iran, Myanmar, and Cuba.11

Meanwhile, the International Consortium of Investigative Journalists has exposed billions of dollars of HSBC involvement with serious criminal activity such as arms and diamond trafficking and misappropriation of state assets. U.S., U.K., and E.U. authorities are also investigating HSBC for manipulating Libor and Euribor benchmark interest rates.12 Crédit Agricole has also been accused of manipulating these benchmark interest rates.13

Undercutting Integrity & Mandate of GCF

The banks' accreditation would undermine the GCF's commitment to robust fiduciary standards and strong environmental and social safeguards as well as gender equality, and would be contrary to what the GCF Secretariat has described as having "GCF standards [that] build on best practices of global institutions."14

In addition, Crédit Agricole and HSBC would move the Fund even further from the diversity and balance that it is seeking to achieve.15 Thus far, the vast majority of GCF resources are expected to flow through developed country/international entities. None of the entities accredited for medium-sized activities and only 20% of entities accredited for large-sized activities are direct access.16 The imbalance in accreditation of national/regional entities versus international entities threatens the GCF's claim to be a transformational institution, as the Secretariat has acknowledged "without a strong role of national and regional institutions the GCF will not be able to fulfil its mandate to create a paradigm shift." 17
